Terms of Service

These Terms of Service ("Terms") govern your use of the RecSpot mobile app, website, and related services (the "Service") provided by RecSpot Corporation d/b/a RecSpot ("RecSpot", "we", "us", or "our"). By using the Service, you agree to these Terms.

These Terms contain a class action waiver, jury waiver, and an agreement to resolve any dispute that may arise by arbitration.

Eligibility

You must be at least 13 years old to use the Service. By using it, you represent that you meet this requirement.

Your Account

You are responsible for keeping your sign-in credentials and any content posted under your account secure. You agree to provide accurate information when you set up your profile.

Content You Post

You retain ownership of recs, photos, comments, and other content you post ("Your Content"). By posting Your Content, you grant us a worldwide, royalty-free, non-exclusive license to host, store, display, reproduce, and distribute Your Content for the purpose of operating, improving, and providing the Service.

You represent that you have the rights needed to post Your Content and that Your Content does not violate anyone else's rights.

RecSpot Content and IP

RecSpot owns or licenses the Service, including the app, website, software, design, logo, trademarks, and related materials. These Terms do not give you ownership of any RecSpot content, technology, branding, or intellectual property.

Objectionable Content Is Prohibited

You agree not to post content that is illegal, hateful, threatening, harassing, defamatory, obscene, pornographic, infringing, or otherwise objectionable. We have zero tolerance for objectionable content and abusive users. We may remove content and terminate accounts that violate these rules without notice.

Moderation

You may report content or users you believe violate these Terms from inside the app. We commit to reviewing reports within 24 hours and taking action where appropriate, which may include removing content, suspending accounts, or terminating users' access to the Service permanently.

Blocking

You may block any other user at any time. Blocked users will not be able to see your content, follow you, or interact with you.

Acceptable Use

You agree not to:

• Impersonate any person or entity.
• Collect or scrape information about other users.
• Use the Service to send unsolicited messages.
• Attempt to disrupt, abuse, reverse engineer, or circumvent the Service or its security.
• Use the Service for any unlawful purpose.

Third-Party Services

The Service uses third-party providers, as described in our Privacy Policy. We are not responsible for the conduct, content, or services of those providers.

Disclaimer

The Service is provided "as is", without warranty of any kind. We make no warranty that the Service will be uninterrupted, error-free, secure, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by law, RecSpot will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Dispute Resolution

You and RecSpot agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service through binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.

You and RecSpot waive the right to a jury trial and agree that disputes will be brought only on an individual basis, not as a plaintiff or class member in any class, consolidated, or representative action.

Termination

We may terminate or suspend your access to the Service at any time, with or without cause. You may stop using the Service and delete your account at any time from Edit Profile.

Changes

We may update these Terms. If changes are material, we'll notify you in-app before the update takes effect. Continued use after the effective date constitutes acceptance.
